First off, I'm a supporter of long hair, but when someone has broken the law and is a prisoner, they are subject to the government's rules. If they don't want their hair cut, they shouldn't be breaking the law.

I agree with Common Sense. Raising this to the level of an international issue (or even a public issue at all) is somewhat ludicrous. Someone convicted a a crime serious enough to warrant prison must forfeit much of his personal freedom. The shearing of hair is certainly not torture, and has been a historic mark of penal systems for years. It seems an appropriate punishment. Investing hair with ideological and religious meaning in the case of prisoners is simply too much. Let the locks fall.
I work in a county jail in Texas. At the state prison,all male inmates heads are shaved upon intake. The reason for it is for the safety and security of both staff and inmates due to placement of contraband in hair. As far as Native American beliefs that you only cut your hair while in mourning,I WOULD SUGGEST THAT BEING IN JAIL IS SUFFICENT REASON TO BE IN MOURNING. I support the right of all people in the free world to wear their hair as they wish,but when you commit a crime and are in prison or jail,you lose the right to wear what you want and that includes hairstyles
You would extend this to jail, too? Don't forget that jail is for the innocent. Prison is for the guilty. I was in jail once but then released. They did cut my hair, but only the hair around my wrist that I'd made into a bracelet.
I hate to be the lone dissenting voice against the "common sense" thread here, because I do buy into the essential logic of that line of reasoning, but, prisoners do have rights. Clearly, incarceration does deprive indivuals of basic liberties, which is the whole point, but that doesn't mean they surrender all their rights.
My only points on the matter are these, for one, in a recent case with similar facts, a judge answered the claim that enforcement of such regulations against male prisoners was discriminatory because women's prisons had no such rules, by writing that the majority of female inmates are non-violent offenders. By his reasoning, grooming regulations which prevented inmates from hiding contraband and weapons in their hair were only necessary for male inmates. That seems a bit tortured to me. Prisoners are prisoners, and when safety is an issue, the general character of the population is less important than the danger posed by the few who actually do act violently. As I see it, that logic only stands up under scrutiny if absolutely no female inmates are violent. It seems more like a pained attempt to justify a long standing double standard then a truly rational explanation.
Secondly, as it relates to Native American prisoners, I think the whole issue diverges some from the context of the larger debate. Inmates are not to be denied a reasonable exercise of their religion, and if maintaining uncut hair is a part of that, then some balance should be sought. Instead, what seems to be the case is that prison officials and courts make no allowance for such practices.
Maybe prisoners are not the greatest poster boys for these kind of rights, but I think Victor's message should be heard.

I guess that you MOURN for your life while you are in jail. With the control on your life, it seems that jail ought to TAKE your LIFE. Hey, the death penalty seems like kind and usual punishment by comparison! Remember, someone once said that "I would rather DIE on my FEET, than LIVE on my KNEES."

Why do people think that long hair will cause someone to commit crimes?
These prisoners have practically forfeited ALL their freedom. They were BROKEN by the STATE! When they are released, they will be brainwashed, uncaring automatons. Remember the Santa Fe Prison riot in 1980? Prisoners became so stir-crazy that they were burning each other's heads with blow-torches! Now, that got rid of the hair!
Sure! Just like the prisoners sixty years ago who were forcibly experimented-on, tortured, abused, etc. by der Fuhrer's government!

On the one hand I agree with you, but I think we talking apples and oranges here. With Hitler a lot of innocent people like Jews, Gays, Minorities as well as other misfits were thrown into prison with criminals, but that is not the case here. Could there be another Hitler and in this country? With what Washington has been producing of late, I sincerely doubt it. Yes, I agree that there have been cases of police wanting to close cases quickly and find someone who could possibly fit the bills of an existing crime thereby resulting in an innocent person being in prison, this is indeed unfortunate but I believe heavily in karma (ancestral as well as personal) or if one wishes to look at the big picture these innocents needed to explore this horror for some signifanct purpose in their lives. Everything happens for a reason even if it doesn't make sense at first.
However, lets not forget that a great percentage of prisoners are guilty of the crime. For running drugs (eh, I find that a debatable offense as if the government can sell alcohol and cigs then what's the difference between marijuana and cocaine - they're all addictive and thats where we should be educating our children on the dangers of all of these), but many of these people have killed others, stolen as well as other horrors. Haircutting? I find this ridiculous and a waste of prison resources. I believe more should be done to rehabilitate these people instead of just locking them up and stripping them of their rights because when they get out, basically you're just letting wild animals back on the streets who in a short period of time go right back to doing what they did to land them in prison because they know no other life. They're not afraid to go back to prison because that's the world they have come to know and be comfortable with. I saw a program a few years ago about a man back east who was using a "deprogramming" type of method to rehabilitate gang members. He would work with them and find out what the motivating factor that drove them to a life of crime, drugs and gangs and he would with a group reprogram more positive beliefs into their minds. I know it sounds like "brainwashing" but he had a high percentage of young men who stopped the violence, got jobs and led a peaceful life. Unfortunately, I heard no more about him and do not know if he's still practicing. Sorry, I got off the subject of hair, but had to mention this.

You obviously have no idea who Hitler was and what he did. If you did, you would know better than to compare him to today's prison systems. Hitler forced innocents into death and labour camps based on the crime of heritage. Since World War II, the United States does not do that. The case here is that the Native American prisoners committed a crime just as bad as a white, black, or Asian criminal, and therefore are subject to the same punishment. If Native Americans were given special treatment, it would destroy the entire system of our prison systems. Comparing cutting long hair to the horrors of Hitler's death camps is not only completly wrong, it's very stupid. Obviously you must be young, wait until you graduate high school, then try to debate.
I'm not being "politically-correct" about Native Americans here; I am talking about practically NON-EXISTENT rights of prisoners. What's next, gassing and cremating prisoners?
Ever heard of the "boiled-frog syndrome"? It is when one restrictive law is passed after another, and the people were willing to accept each law as only a "little bit", but pretty soon those "little bits" can add up to a lot. Apparently, people get USED TO more and more restriction over a long time, just like the frog who is getting USED TO the boiling water. And you think that Hitler came in with a bang rather than a wimper! Remember, "the road to ruin is paved with good intentions."
Also, what are you talking about punishment? Some skinhead gangs would think of hair-cuts as a REWARD!
We can't compare them now, but we must never forget that it can happen again. We need to recognize it so we can stop it before it happens again. For example, we need to be aware if they start shipping the homeless people to isolated prison camps or giving people long prison sentences for transporting one carton of cigarettes into a state that charges extra taxes on cigarettes.
I've read about the persecution of longhairs in the state prison system. It is real. The Sikh religion, which also forbids the cutting of hair, has been fighting this new atrocity as well.
I have as well read they are not wrestling longhairs to the ground and forcibly mutilating them, but like the letter said, they are punishing them by denying them amenities that other prisoners get. Perhaps if our people can hold out for a few months, something can be done. This present horrible governor has vetoed every responsible piece of social legislation that the legislature has passed, but his term is up at the first of the year, and the man we elected to replace him, Gray Davis, appears to be a man who shows human compassion.
The justification for the policy has been a misconception that having short hair bolsters self-esteem, no doubt with an undercurrent of punishment. But shearing a man whose religion calls for long hair, or a man who has a longhaired identity, is not esteem-building, it is demeaning. And the level of punishment he feels is far more than that felt by others - it's as fair as depriving all prisoners of candy and watching the diabetics really squirm.
No one asks for a longhaired identity, it's something those of us who have it have had since our earliest memories. For us, our hair is as spiritual as our religion - it is part of who we are. Most of us have tried going the short-hair route, and we know from actual experience that, despite the discrimination around, we need our long hair to really soar.
This spiritual part of our being is supposed to be protected - that's what the First Amendment is all about. Furthermore, hair length has been long established as a concern of religion - it is mentioned in the Bible, not just in verbal Indian traditions. The essence of the First Amendment is that we don't have to agree with the Bible, or with the Indians, or the Sikhs, but that each of us has a right to practice matters in the perview of religion in our own way. We thus must fight for the protection of all longhairs.
Another injustice in this kind of mutilation is that the punishment extends beyond the term of sentence. It takes six years to regrow one's hair to terminal length, so a man returns to society with the intense embarrassment of being shorn to burden him with the already tough burdens of being "a con".
All this may not sound severe to some of you for a guy coming out of a twenty-year sentence until you consider this: If they get away with mutilating longhairs in prison, will jail be next? If withholding privileges is deemed okay, will forcible amputation of our manes be next? How would you like to be mutilated for six years as punishment for jaywalking!
We've got to show solidarity with our brethren. This, dudes, is something we've got to fight.

I don't know if the prison grooming code would help or hurt long hairs.
When the media publicizes longhaired convicted murderers, at least some people become afraid of long hair. Publicizing the Charles Manson case may have encouraged people outside of jail to get haircuts. If all prisoners had short hair, long hair may become more acceptable outside of jail.
But for minor crimes, forced haircuts could be considered cruel and unusual punishment. Imagine going to jail for an hour and getting a haircut for smoking a cigarette in public.
When someone is arrested for a crime, they should not be given a haircut because they could be found innocent. If someone is forced to get a haircut and found innocent they could sue the jail, adding more costs for taxpayers to pay.
